Section 173-360-395. Applicability to previously closed UST systems.

- When directed by the department or delegated agency, the owner or operator of an UST system permanently closed or abandoned before December 22, 1988, shall have a person registered to perform site assessments assess the site and shall have a licensed tank services provider close the UST system in accordance with WAC 173-360-380 through 173-360-398 if releases from the UST may, in the judgment of the department or delegated agency, pose a current or potential threat to human health and the environment.[Statutory Authority: Chapter 90.76 RCW.
