Section 170-03-0170. Notice of hearing.

- (1) When a hearing is requested, OAH sends the parties a written notice of the hearing or prehearing conference.(2) The notice of hearing or prehearing conference will include:(a) The names, mailing addresses, and telephone numbers of all parties and of their representatives;(b) The name, mailing address, and telephone number of the ALJ;(c) The date, time, place, and nature of the hearing or prehearing conference;(d) The legal authority and jurisdiction for the hearing or prehearing conference; and(e) The date of the hearing request.(3) OAH also will send information with the notice of hearing or prehearing conference stating:(a) If a party and the party's representative fail to attend or participate in a prehearing conference or a hearing, that party may lose the right to a hearing and the ALJ may enter an order of default or an order dismissing the case.(b) If a party or witness needs a qualified interpreter because the party or witness is entitled to an interpreter under WAC 170-03-0110 and 170-03-0130, OAH will provide an interpreter at no cost.(c) Whether the hearing or prehearing conference is to be held by telephone or in person, and how to request a change in the way it is held.(d) How to indicate any special needs for a party or witness.(e) How to contact OAH if a party or witness has a safety concern.
