EMERGENCY RULES

[ Order 10-189 -- Filed July 29, 2010, 8:58 a.m. , effective August 1, 2010 ]

     Effective Date of Rule: August 1, 2010.

     Purpose: Amend personal use fishing rules.

     Citation of Existing Rules Affected by this Order: Repealing WAC 232-28-61900N; and amending WAC 232-28-619.

     Statutory Authority for Adoption: RCW 77.12.047 and 77.04.020.

     Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.

     Reasons for this Finding: This emergency regulation provides fishing opportunity for the recreational angler. There is insufficient time to adopt permanent rules.

NEW SECTION
WAC 232-28-61900N   Exceptions to statewide rules -- Clarks Creek (Pierce Co.)   Notwithstanding the provisions of WAC 232-28-619, effective August 1 through October 31, 2010, a person may fish for game fish in waters of Clarks Creek from the mouth of Clarks Creek upstream to 12th Ave. SW. Daily limit of two trout over 14 inches in length; statewide minimum size and daily limits apply for all other game fish. Release wild steelhead and selective gear rules in effect.
