PROCLAMATION BY THE GOVERNOR 08-11
AMENDING PROCLAMATION 08-10
WHEREAS, a severe winter storm began on December 15, 2008 and is forecast to continue for several weeks threatening citizens and property of Washington State; and
This winter storm with blizzard conditions follows weeks of record or near record snowfall, wind, freezing rain, and ice causing hazardous conditions for citizens, homes, businesses, public utilities and infrastructure in all jurisdictions of Washington State; and
On December 24, 2008, I issued Proclamation 08-10, proclaiming a state of emergency statewide as a result of the winter storm disaster ongoing at that time, and waiving certain driver hours of service regulations relating to the milk bulk carrier industry for a period of ten (10) days; and
The continued, severe weather systems bringing snow and heavy rains are continuing to cause road damage, closures and delays, local flooding, landslides, and existing and predicted closure of major transportation routes across the state as necessary for road clearing and avalanche control, and that these extreme transportation delays continue to affect dairy farmers, dairy plant capacity, and milk haulers' ability to deliver within the time limits prescribed by driver hours of service rules throughout the state; and
It is now apparent the existing state of emergency continues as a result of the persistent winter storms and their impact on roads, the transportation system, and delivery of milk products, and it is necessary to extend the waiver of the driver hours of service included in Proclamation 08-10;
NOW, THEREFORE, I, Christine O. Gregoire, Governor of the state of Washington, as a result of the aforementioned situation and under Chapters 38.52 and 43.06 RCW, do hereby proclaim that the State of Emergency I proclaimed in Proclamation 08-10 continues throughout the State of Washington, that Proclamation 08-10 remains in effect, and that I hereby waive driver hours of service rules described in WAC 480-14-380(2) and WAC 480-31-130, as they apply to drivers operating trucks hauling bulk milk intrastate from farms to dairy processing facilities, and interplant between dairies and processing facilities, through January 12, 2009. This continued emergency proclamation serves to suspend federal rules limiting driver hours of service for this additional period. I again ask the bulk milk industry to use their best judgment in delivering their products in a manner that ensures public and driver safety during this period.
