Section 491-04-180. Can new evidence be submitted for the hearing?

The board must base its decision on the information in the agency file as it existed on the date of the agency decision. New medical or vocational information offered by either party cannot be considered. If the appealing party feels it has new evidence that may change a local board or staff decision, it should withdraw its request for a hearing and ask the local board or staff to reconsider its decision with the new evidence.
