Section 480-110-235. Definition of control.

- (1) For purposes of determining commission jurisdiction over a water company as defined in RCW 80.04.010, "control" means the water system operator or manager has discretion over the property or finances or operations of a water company which is normally exercised by an owner. Factors indicating control include, but are not limited to, whether the operator or manager:(a) May authorize the purchase or sale of all or part of the water system or its water rights;(b) May authorize capital additions or improvements to the system;(c) May accept contributed plant;(d) May authorize the expenditure or acquisition of funds that encumber any asset of the company;(e) May authorize the expenditure of funds for nonwater company purposes;(f) Receives compensation of a type or amount having no reasonable relationship to the work performed or to be performed.(2) Control does not include management by a satellite agency as defined in chapter 70.116 RCW if the satellite agency is not an owner of the water company.[Statutory Authority: RCW 80.01.040, 80.04.160, 81.04.160 and 34.05.353.
