- These rules are applicable to all Washington state entities, public or private, which own, operate, or maintain RFGS that are not regulated by the Federal Railroad Administration.These rules apply to all owners of rail fixed guideway systems as defined by RCW 81.104.015 which are required by RCW 35.21.228, 35A.21.300, 36.01.210, 36.57.120, 36.57A.170, or 81.112.180 to comply with the requirements of the Washington state department of transportation for the development and implementation of a system safety program plan and a security and emergency preparedness plan.[Statutory Authority: RCW 81.104.115.
