Section 458-30-540. Waiver of exemption.

- (1) Introduction. This section explains the owner's right to waive the exemption relating to special benefit assessments as set forth in RCW 84.34.320.(2) Owner may waive exemption. The owner of land exempted from special benefit assessments may waive this exemption by filing a notarized statement to that effect with the legislative authority of the local government creating the district after receiving notice from local government concerning the assessment roll hearing. This statement must be filed before the local government confirms the final special benefit assessment roll.(3) Copy of waiver to assessor. A copy of this waiver shall be filed by the local government with the assessor and the county legislative authority, but the failure to file this document shall not affect the waiver.[Statutory Authority: RCW 84.08.110, 84.08.070, 84.34.141 and 84.34.360.
