Section 392-172A-06080. Requirements for establishing eligibility.

- (1) School districts that establish joint eligibility under this section must:(a) Adopt policies and procedures that are consistent with the state's policies and procedures under WAC 392-172A-06005; and(b) Be jointly responsible for implementing programs that receive assistance under Part B of the act.(2) If an educational service agency has authority to carry out programs under part B of the act, the joint responsibilities given to school districts:(a) Do not apply to the administration and disbursement of any payments received by the educational service agency; and(b) Must be carried out only by that educational service agency.(3) Regardless of any other provisions in WAC 392-172A-06075 and 392-172A-06080, an educational service agency must provide for the education of eligible students in the least restrictive environment.[Statutory Authority: RCW 28A.155.090 and 34 C.F.R.
