Section 392-164-175. Guardian—Definition.

- As used in this chapter, the term "guardian" means a person who:(1) Has been appointed to be the legal guardian of a child through formal proceedings in accordance with state law;(2) Would qualify as a legal guardian of a particular child under Washington state law if formal guardianship proceedings were undertaken; or(3) Is standing in the place of a parent to a child by virtue of the fact that, with apparent parental consent, the child resides with such person: Provided, That if no objection has been filed to such residency, parental consent may be presumed.[Statutory Authority: RCW 28A.02.100.
