- (1) The resident has the right, unless to do so would infringe upon the rights or health and safety of other residents, to:(a) Retain and use personal possessions, including some furnishings, and appropriate clothing, as space permits;(b) Provide his or her own bed and other furniture, if desired and space permits; and(c) Not be required to keep personal property locked in the facility office, safe, or similar arrangement.(2) The nursing home must:(a) Not request or require residents to sign waivers of potential liability for losses of personal property; and(b) Have a system in place to safeguard personal property within the nursing home that protects the personal property and yet allows the resident to use his or her property.
