Chapter 388-145. Licensing requirements for group care facilities and services. |
Section 388-145-2190. How many children may be served in my staffed residential home?

- (1) The department may license a staffed residential home for six or fewer children. This must include the children of youth in care, as well as other children living in the facility who are not in care. The maximum number of children in your staffed residential home must not exceed six at any time to include youth eighteen or older enrolled in the Extended Foster Care program.(2) The department may restrict the number of children in a staffed residential home according to the age and needs of the children.(3) Except for programs for pregnant and parenting youth, you may have only two children under two years of age in your facility at a time.(4) You must only be licensed for a maximum of three pregnant and parenting youth.(5) The department may license a staffed residential home for up to three children with mental or physical disabilities that are severe enough to require nursing care if you meet the following conditions:(a) You provide staff that are qualified by training and experience to provide proper care, including necessary medical procedures; and(b) The children's treatment is under the supervision of a physician.
