Chapter 388-107. Licensing requirements for enhanced services facilities. |
Section 388-107-0890. Outdoor recreation space and walkways.

- (1) The enhanced services facility must provide a safe, protected outdoor area for resident use.(2) The facility must ensure the outdoor area:(a) Has areas protected from direct sunshine and rain throughout the day;(b) Can be accessed by the resident;(c) Has walking surfaces that are firm, stable, and free from cracks and abrupt changes with a maximum of one inch between the sidewalk and adjoining landscape areas;(d) Has sufficient space and outdoor furniture provided with flexibility in arrangement of the furniture to accommodate residents who use wheelchairs and mobility aids;(e) Contains nonpoisonous shrubs, natural foliage, and trees;(f) Is surrounded by walls or fences at least seventy-two inches high; and(g) If used as a resident courtyard, the outdoor area must not be used for public or service deliveries.
