Section 371-08-405. Jurisdictional requirements of the board—Dismissal on jurisdictional grounds.

- (1) Timely filing of the notice of appeal with the board and timely service of the notice of appeal on the appropriate agency are required for the board to acquire jurisdiction.(2) Any party may challenge the jurisdiction of the board to hear an appeal, and the board may independently raise the jurisdictional issue.
