- You must:• Transfer all material safety data sheets (MSDSs) as exposure records to the successor employer, who must do the following to these records:– Received– Preserve– Keep unchanged• If there is no successor to receive and preserve the employee exposure records:– Notify affected current employees of their rights of access to records at least 3 months prior to the cessation of the employer's businessand– Transfer the records to the department, if required by a specific WISHA safety and health rule.[Statutory Authority: RCW 49.17.010, [49.17].040, and [49.17].050.
