Section 296-62-07621. Communication of hazards.

- (1) Hazard communication - General.(a) Chemical manufacturers, importers, distributors, and employers shall comply with all requirements of the Hazard Communication Standard (HCS), WAC 296-901-140 for MDA.(b) In classifying the hazards of MDA at least the following hazards are to be addressed: Cancer; liver effects; and skin sensitization.(c) Employers shall include MDA in the hazard communication program established to comply with the HCS, WAC 296-901-140. Employers shall ensure that each employee has access to labels on containers of MDA and to safety data sheets, and is trained in accordance with the requirements of HCS and subsection (4) of this section.(2) Signs and labels.(a) Signs.(i) The employer shall post and maintain legible signs demarcating regulated areas and entrances or accessways to regulated areas that bear the following legend:DANGER MDA MAY CAUSE CANCERCAUSES DAMAGE TO THE LIVERRESPIRATORY PROTECTION AND PROTECTIVE CLOTHINGMAY BE REQUIRED TO BE WORN IN THIS AREA(ii) Prior to June 1, 2016, employers may use the following legend in lieu of that specified in (a)(i) of this subsection:DANGER MDA MAY CAUSE CANCER LIVER TOXINAUTHORIZED PERSONNEL ONLYRESPIRATORS AND PROTECTIVE CLOTHINGMAY BE REQUIRED TO BE WORN IN THIS AREA(b) Labels. Prior to June 1, 2015, employers may include the following information workplace labels in lieu of the labeling requirements in subsection (1) of this section:(i) For pure MDA:DANGER CONTAINS MDA MAY CAUSE CANCER LIVER TOXIN(ii) For mixtures containing MDA:DANGER CONTAINS MDA CONTAINS MATERIALSWHICH MAY CAUSE CANCER LIVER TOXIN(3) Safety data sheets (SDS). In meeting the obligation to provide safety data sheets, employers shall make appropriate use of the information found in Appendices A and B to WAC 296-62-076.(4) Information and training.(a) The employer shall provide employees with information and training on MDA, in accordance with WAC 296-901-14016, at the time of initial assignment and at least annually thereafter.(b) In addition to the information required under WAC 296-901-140, the employer shall:(i) Provide an explanation of the contents of WAC 296-62-076, including Appendices A and B, and indicate to employees where a copy of the standard is available;(ii) Describe the medical surveillance program required under WAC 296-62-07625, and explain the information contained in Appendix C; and(iii) Describe the medical removal provision required under WAC 296-62-07625.(5) Access to training materials.(a) The employer shall make readily available to all affected employees, without cost, all written materials relating to the employee training program, including a copy of this regulation.(b) The employer shall provide to the director, upon request, all information and training materials relating to the employee information and training program.[Statutory Authority: RCW 49.17.010, 49.17.040, 49.17.050, 49.17.060 and 29 C.F.R. 1910 Subpart Z.
