- (1) An employee aggrieved by any act in violation of chapter 49.76 RCW and these rules has the right to file a civil action in court for an injunction, actual damages, costs, and reasonable attorneys' fees.(2) An employee need not exhaust administrative remedies before filing a civil action.(3) The right to file a civil action under RCW 49.76.100 is in addition to any common law remedy or any other remedy that may be available to an employee.[Statutory Authority: Chapter 49.76 RCW and 2008 c 286.
