Section 208-660-105. How does the department interpret the definition of residential mortgage loan modification services in RCW 19.146.010(21)?

- Residential mortgage loan modification services means activities conducted by persons not engaged in servicing the borrower's existing residential mortgage loan. The activities may include negotiating, attempting to negotiate, arranging, attempting to arrange, or otherwise offering to perform residential mortgage loan modification services. The activities may also include the collection of data for submission to another person performing mortgage loan modification services or to a residential mortgage loan servicer.Any person in violation of the act while providing residential mortgage loan modification services is subject to the department's investigation and enforcement authorities including being responsible for an investigation fee when the department investigates the books and records of any person subject to the act.[Statutory Authority: Chapter 43.320 RCW, RCW 19.146.223.
