Section 182-526-0115. Withdrawing the request for hearing.

  • (1) The party who requested the hearing may withdraw the hearing request for any reason and at any time by contacting the health care authority hearing representative or the office of administrative hearings (OAH). The request for withdrawal must be made in writing or orally with the administrative law judge and the other parties.
    (2) After the request for withdrawal is received, the hearing is canceled and OAH enters and serves an order dismissing the hearing. If a hearing request is withdrawn, the party may not be able to request another hearing on the same action.
    (3) If a party withdraws the hearing request, the order of dismissal may only be set aside according to WAC 182-526-0290.
