Section 173-901-050. Prohibition on the sale of certain brake friction materials.

- (1) Beginning January 1, 2015, no manufacturer, wholesaler, distributor, installer, or retailer of brake friction material nor any manufacturer of motor vehicles may sell or offer for sale brake friction material in Washington state that:(a) Contains asbestiform fibers in concentrations exceeding 0.1 percent by weight;(b) Contains cadmium and its compounds in concentrations exceeding 0.01 percent by weight;(c) Contains chromium (VI)-salts in concentrations exceeding 0.1 percent by weight;(d) Contains lead and its compounds in concentrations exceeding 0.1 percent by weight; or(e) Contains mercury and its compounds in concentrations exceeding 0.1 percent by weight.(2) Beginning January 1, 2021, no manufacturer, wholesaler, retailer, installer or distributor of brake friction material nor any manufacturer of motor vehicles may sell or offer for sale brake friction material in Washington state containing more than five percent copper and its compounds by weight.(3) Exemptions:(a) Brake friction material manufactured prior to 2015 is exempt from subsections (1) and (2) of this section for the purposes of clearing inventory. This exemption expires January 1, 2025.(b) Brake friction material manufactured prior to 2021 is exempt from subsection (2) of this section for the purposes of clearing inventory. This exemption expires January 1, 2031.(c) Brake friction material manufactured as part of an original equipment service contract for vehicles manufactured prior to January 1, 2015, is exempt from subsections (1) and (2) of this section.
