Section 173-304-015. Applicability.

- These regulations apply to solid wastes as that term is defined in WAC 173-304-100. These regulations shall not apply to the following solid wastes:(1) Overburden from mining operations intended for return to the mine;(2) Liquid wastes whose discharge or potential discharge is regulated under federal, state or local water pollution permits;(4) Woodwaste used for ornamental, animal bedding, mulch and plant bedding, or roadbuilding purposes;(5) Agricultural wastes, limited to manures and crop residues, returned to the soils at agronomic rates;(6) Clean soils and clean dredge spoils as defined in WAC 173-304-100 or as otherwise regulated by section 404 of the Federal Clean Water Act (PL 95-217);(7) Septage taken to a sewage treatment plant permitted under chapter 90.48 RCW;(9) Wood debris resulting from the harvesting of timber and whose disposal is permitted under chapter 76.04 RCW, the State Forest Practices Act.[Statutory Authority: Chapter 43.21A RCW.
