Section 170-03-0340. Conduct of hearings.

- (1) Hearings may be held in person or by telephone conference or other electronic means.(2) All parties, their representatives and witnesses may attend the hearing in person or by telephone conference or other electronic means at the discretion of the ALJ.(3) Whether a hearing is held in person or by telephone conference, the parties have the right to see all documents, hear all testimony and question all witnesses.(4) When a hearing is held by telephone or other electronic means, all documentary evidence must be filed and served in advance of the hearing.(5) All hearings must be recorded.
