Section 170-03-0050. Requesting a hearing.

- (1) A request for hearing must be made in writing. DEL will provide forms that requesting parties may use to request a hearing. The request for hearing can be made by the party requesting the hearing or by the party's representative.(2) The hearing request shall include:(a) The requesting party's name, address, and telephone number;(b) A brief explanation of why the requesting party disagrees with the DEL adverse action;(c) Any assistance, such as a foreign or sign language interpreter or accommodation for a disability, needed by the requesting party;(d) A copy of the notice from DEL stating the adverse action.(3) Within twenty-eight days of receipt of notice of DEL's adverse action, the request shall be filed with OAH and served on DEL.
